If I photograph a piece of art, I own the photograph, but i can't commercialize on it OR I have to include the name of the artist with any public showing. Rhetorically, is taking a photo a violation of the artist's work? No payment exchanged hands.

Suppose I really crave a splashly tattoo of a corporate trademark. Is the artist's rendition of the corporate logo a violation or is it the person who bought the art / design from the tattoo-ist? Because the client paid for the design, who was exploited?
