Does a custom tattoo design really have copyright protection? The simple answer: Yes, an original tattoo design is a copyrightable work. Keep in mind the requirement is that the work be original not unique. This means that a tattoo artist can have copyright protection for a Japanese dragon if the design is his or her own expression of that motif.

Music Mayhem Dave Hause is not a tattoo enthusiast. He actually admits to being a bit of a tattoo snob and usually hates everyone else’s tattoos, opting for a more specialized tattoo style for himself. But just taking one look at him and all the band tattoos adorning his body, you wouldn’t be able to tell.

Some people bet money and others wager pink slips but body art enthusiast Keith Ware plays for tattoos. The former Infantry Solder won 80 percent of his tattoos playing pool everywhere from Texas to Italy against other soldiers. "I got hooked on tattoos from the first one," Ware says. "They are very addicting."

Above the teeming streets of Temple Bar, where even the fire juggler’s torches can’t reach, sits Zulu Tattoo. Perhaps the premier studio in Dublin, tattoo flash is displayed on the walls giving inspiration to those who need it. Buried deep among the design books on the tables sits a bland, black folder marked “Old School.” Largely ignored, this folder contains the relics of yesteryears, pictures of leprechauns and flags, shamrocks and harps.

My Town Walking down a San Diego beach on a warm sunny day you’ll be hard pressed to find any scantily-clad sun bather without a work of art to display on their skin. The city’s warm weather helps the tattoo scene gain its popularity simply by allowing the bodyart enthusiast to clearly display their ink for the world to see. “We have a lot more tourism here,” Jim Thomas of Black Rose Tattoo says. “And we have the beach so there’s a lot more skin showing so of course a lot more people are interested in body art than elsewhere in the U.S.”

My Shop Once the thriving center for free love and all things groovy, San Francisco’s famous Haight Street today feels more hipster than hippie. Amidst the overpriced thrift stores and numerous free-trade coffee options, trendy tourists will be thrilled to find there are roughly a half dozen tattoo shops on the street if they want to commemorate their trip with something a little sharper than a Golden Gate snow globe. For the true ink connoisseurs Mom’s Body Shop is the only tattoo artist owned and operated shop on the street, and probably the most expensive.
